Belangrijke stap gezet bij hervorming rechtspraak

De rechterlijke macht heeft vandaag een aantal belangrijke wijzigingen ondergaan met het in werking treden van een aantal grondwetswijzigingen die het parlement in juni van dit jaar goedkeurde. Voortaan is het niet meer de president die het recht heeft om rechtbanken te creëren of op te heffen, maar het parlement.

Een andere wijziging betreft de opheffing van een aantal gespecialiseerde hogere rechtbanken. De Hoge Raad blijft bestaan, maar alle huidige rechters worden vervangen. Rechters krijgen voortaan beter betaald, maar ze gaan niet langer vrijuit als ze betrapt worden op het plegen van misdrijven als aannemen van smeergeld of het veroorzaken van een verkeersongeluk. Er komt een aparte instelling die toestemming moet geven voor arrestatie en het ontslaan van rechters die in de fout zijn gegaan.

Vooruitlopend op de veranderingen bij de rechterlijke macht besloot het parlement gisteren al om 29 rechters te ontslaan wegens machtsmisbruik. Nog eens 778 rechters hebben hun wettelijke ambtstermijn er op zitten, maar over hun ontslag werd het parlement het nog niet eens.

The High Council of Justice will be replaced by the High Council of Jurisdiction. It will give consent to the detention, arrest and dismissal of judges. The "violation of the oath" will be excluded from the possible reasons for dismissal. Prior to the judicial reform, 29 judges were dismissed by the Verkhovna Rada on the proposal of the High Council of Justice, including those who had convicted Maidan protesters.
